These Terms and Conditions govern your access to and use of BazaarCheap, including our website, seller dashboard, storefront tools, product and service listing features, messaging and sharing features, and related services.

By creating an account, accessing the platform, or using any BazaarCheap service, you agree to be bound by these Terms. If you do not agree, you must not use the platform.

You may use BazaarCheap only if you are legally capable of entering into a binding agreement under applicable law. If you use the platform on behalf of a business or other organization, you represent that you have authority to bind that entity to these Terms.

You are responsible for maintaining the confidentiality of your login credentials, for all activity that occurs under your account, and for ensuring that the information you provide to us is accurate, current, and complete.

BazaarCheap is a technology platform that enables businesses and individuals to create public online storefronts and publish catalogues of products or services.

Visitors may browse storefronts, search for products or services, view listings, add selected products to a cart, share cart contents, copy and share catalogue links, and use available contact options to communicate directly with sellers.

The BazaarCheap cart is a product selection and sharing tool. Adding an item to a cart or sharing a cart does not place an order, reserve a product, create a sale, or require a seller to provide the selected items.

BazaarCheap does not sell the products or services displayed on storefronts and is not a party to any sale, purchase, delivery arrangement, or other transaction between a seller and a customer.

Any communication, product confirmation, negotiation, payment, purchase, delivery, refund, return, or other arrangement between a seller and a customer takes place directly between those parties.

BazaarCheap does not process payments, accept orders on behalf of sellers, reserve products, arrange delivery, or guarantee transactions between users.

If you create or manage a business profile, you are solely responsible for your store name, descriptions, pricing, availability, images, categories, contact details, policies, and all other content you upload, publish, or make available through the platform.

You represent and warrant that your listings, branding, and business information are lawful, accurate, non-misleading, and do not infringe any third-party rights, including intellectual property, privacy, publicity, or consumer protection rights.

Sellers are responsible for keeping prices, product or service descriptions, availability information, images, and other catalogue information accurate and reasonably up to date. BazaarCheap does not guarantee that a product or service displayed in a catalogue remains available when a customer contacts the seller.

Sellers are responsible for complying with laws and disclosure requirements applicable to the advertising, offering, sale, or supply of their products or services.

We may remove, restrict, edit, or refuse content that we reasonably believe violates these Terms, applicable law, or the integrity of the platform.

BazaarCheap may allow users to add products to a cart and share selected items through supported sharing options, including third-party communication services or a shareable link.

A BazaarCheap cart is provided for convenience and product sharing only. It is not a checkout facility and does not constitute an order, booking, reservation, payment, or completed transaction.

Prices and availability shown in a cart or shared cart reflect the information available on BazaarCheap at the time the cart or link is accessed and may be changed by the seller.

Users should confirm prices, product or service availability, quantities, payment arrangements, delivery terms, and other transaction details directly with the relevant seller.

BazaarCheap does not guarantee that a seller will respond to a shared cart or message, that selected items remain available, or that communication between a seller and a customer will result in a transaction.

Users should not send money in advance to sellers they do not know or have not independently verified. BazaarCheap does not process payments and is not responsible for losses arising from payments sent to unknown, unverified, fraudulent, or impersonating sellers.

Communications and transactions that take place through WhatsApp or other third-party services are also subject to the terms and policies of those services.

You must not use BazaarCheap to engage in fraud, deceptive trade practices, spam, harassment, infringement, unlawful surveillance, unauthorized data scraping, malware distribution, platform abuse, or any activity that violates applicable law or the rights of others.

You must not upload or list illegal goods or services, counterfeit items, restricted products, or content that is defamatory, obscene, discriminatory, abusive, or otherwise unlawful.

You must not interfere with the security, stability, or normal operation of the platform, including by attempting to bypass access controls, reverse engineer protected functionality, or overload the service.

As between you and BazaarCheap, BazaarCheap and its licensors retain all rights, title, and interest in the platform, including its software, design, branding, text, interfaces, and underlying technology.

You retain ownership of content you submit, but you grant BazaarCheap a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt, display, publish, and distribute that content as reasonably necessary to operate, improve, promote, and secure the platform.

You may not copy, modify, distribute, sell, lease, or create derivative works from the platform except as expressly permitted by applicable law or by our prior written consent.

We may suspend, restrict, or terminate your access to BazaarCheap at any time, with or without notice, if we reasonably believe that you have violated these Terms, created legal exposure, endangered users, or misused the platform.

You may stop using the platform at any time. Termination does not relieve you of obligations that accrued before termination, including obligations relating to transactions, disputes, indemnity, or content you previously submitted.

Product, service, business, price, availability, and other storefront information displayed on BazaarCheap is generally provided by sellers.

BazaarCheap does not guarantee that seller information is complete, accurate, current, or error-free.

We may provide tools that allow sellers to manage and update their catalogues, but sellers remain responsible for the information they publish.

BazaarCheap does not guarantee the quality, safety, legality, authenticity, suitability, or availability of products or services displayed by sellers.

To the extent permitted by applicable law, users are responsible for confirming relevant information directly with a seller before entering into a transaction.

BazaarCheap is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, BazaarCheap disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and uninterrupted operation.

To the fullest extent permitted by law, BazaarCheap and its affiliates, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, business opportunities, or anticipated savings arising out of or related to your use of the platform.

To the fullest extent permitted by law, BazaarCheap will not be liable for losses, damages, or claims arising from fraud, scams, counterfeit goods, fake products, non-delivery, delayed delivery, payment disputes, unauthorized transfers, seller misconduct, buyer misconduct, or any transaction entered into between users of the platform.

To the fullest extent permitted by law, BazaarCheap's aggregate liability for claims arising out of or relating to the platform or these Terms will not exceed the greater of the amount you paid to BazaarCheap for the relevant service during the twelve months preceding the claim or USD 100.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

You agree to defend, indemnify, and hold harmless BazaarCheap and its affiliates, officers, directors, personnel, contractors, and partners from and against any claims, demands, actions, damages, losses, liabilities, judgments, penalties, costs, and expenses, including reasonable legal fees, arising out of or related to your content, listings, business operations, transactions with customers, violation of these Terms, or violation of any law or third-party right.

The platform may integrate with or link to third-party services, websites, payment tools, messaging tools, hosting services, or communication channels. BazaarCheap is not responsible for the content, availability, policies, or practices of third parties, and your use of third-party services is governed by their own terms and policies.

We may modify, suspend, discontinue, or update any part of the platform at any time. We may also update these Terms from time to time. The updated version becomes effective when posted unless a later date is stated.

Your continued use of BazaarCheap after revised Terms become effective constitutes your acceptance of the revised Terms.

These Terms are governed by the laws applicable in the jurisdiction of BazaarCheap's principal place of business, without regard to conflict-of-law rules, except to the extent mandatory law requires otherwise.

Before filing a formal claim, you agree to make a good-faith effort to resolve the dispute by contacting BazaarCheap through the support channels made available on the platform.

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision or any other right.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, restructuring, or transfer of the platform or related business.

These Terms constitute the entire agreement between you and BazaarCheap regarding the subject matter covered here and supersede prior or contemporaneous understandings relating to that subject matter.
